Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and OpenLeap AI LLC, a Washington limited liability company doing business as BizFocus AI (“OpenLeap AI”, “BizFocus AI”, “we”, “us”, “our”). By using our website or purchasing our services, you agree to these Terms.

1. The service

BizFocus AI provides two products: a free AI Diagnostic that gives you an estimated AI Opportunity Cost figure and your top three industry-specific automation opportunities; and the AI Business Audit — a paid 7-section, custom-built operational analysis report with verified tool recommendations, ROI modelling, and an implementation roadmap.

2. Purchase terms

The AI Business Audit is sold for $499 as a one-time payment. Each purchase grants one audit credit, redeemable for one report. Reports are delivered within 48 hours of you completing the post-purchase intake (voice interview or form). All payments are processed by Stripe; we do not receive or store your card details.

3. The 3-opportunity guarantee & money-back refund

Eligibility. If your delivered AI Business Audit does not identify at least 3 relevant, implementable AI opportunities for your business, you are entitled to a full refund.

Window. Requests must be made within 7 days of report delivery. The audit intake must have been completed so a report could be produced and assessed.

How to request. Email contact@bizfocus.ai from the same address you purchased with — no forms, no questions. Refunds are returned to the original payment method within 7 business days. After a refund, your access to the report is revoked.

4. Reports are informational, not advice

The AI Diagnostic and AI Business Audit are informational business guidance only — not professional advice. They are not a substitute for legal, financial, accounting, tax, medical, or other professional advice specific to your business, and you should consult a qualified professional before acting. We do not guarantee any particular business result — including savings, revenue, cost reduction, or return on investment. Cost estimates and ROI projections are illustrative and depend on your implementation and market conditions. Recommendations rely on third-party tools, pricing, and information that can change without notice; you are responsible for independently verifying any tool, price, or claim before relying on it.

5. Intellectual property

We own the BizFocus AI platform and all intellectual property in it — including our methodology, prompts, opportunity library, tool database, report templates, software, and branding. You retain ownership of the business information you provide to us. When we deliver your audit report, we grant you a limited, non-exclusive, non-transferable license to use that report and its deliverables for your own internal business purposes. You may not resell, sublicense, or publicly redistribute the report or the underlying platform (see Section 7).

6. Your responsibilities

• Provide accurate information when you complete the diagnostic or audit intake. Report quality depends on the accuracy of what you tell us.
• Maintain one account per person. Sharing an account between multiple users or businesses is not permitted.
• Keep your account credentials secure. You are responsible for any activity under your account until you notify us otherwise.

7. Acceptable use

You may not:

• Resell, sublicense, or redistribute your audit report or any portion of the BizFocus AI service.
• Reverse-engineer, decompile, or attempt to extract the underlying methodology, prompts, opportunity library, or tool database.
• Use the service to generate reports for third-party businesses without their consent.
• Submit deliberately false or misleading information to generate distorted reports.
• Attempt to disrupt the service, scrape it at scale, or bypass any rate limits or access controls.

8. Disclaimer of warranties

The service and every report are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service or its outputs will be accurate, complete, current, uninterrupted, or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

9. Limitation of liability

To the maximum extent permitted by law, the aggregate liability of OpenLeap AI LLC (d/b/a BizFocus AI) arising from or relating to your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, consequential, special, or punitive damages — including loss of profits, revenue, data, or business opportunity — even if advised of the possibility.

10. Indemnification

You agree to indemnify, defend, and hold harmless OpenLeap AI LLC and its BizFocus AI brand, and their respective members, officers, employees, and agents, from and against any claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) any decision you make or action you take in reliance on a diagnostic or audit report.

11. Termination

You may stop using the service at any time and request account deletion from your account settings. We may suspend or terminate accounts that breach these Terms, with notice where practical.

12. Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict of law provisions.

13. Dispute resolution

Before starting any formal proceeding, you agree to first contact us at contact@bizfocus.ai and attempt in good faith to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of those courts.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Changes to these terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the current version. Material changes will be communicated by email to active users at least 14 days before they take effect.
